Conflict with Builder

We have lived in our home for 2.5yrs and have discovered a hidden leak under our tile shower. Our shower pan has leaked for a ''very long time'' we are the first owners of a this house. Our Builder is blaming the tile person and no one wants to replace it. We have an estimate of 6k to tear fix it. Our insurance agent told us about a Statute of Repose for 6yrs in the state of NC. Is there any way to get them to repair the problem.

Unfortunately, you will most likely need to consult with an attorney to review your facts. The builder may well be responsible but you will either need to legal research and write a letter or hire an attorney. Depending on the builder's response and his financial ability, it may be worth it. But the practical point is that even if you have good legal theories in holding the builder responsible, if he does not agree to pay, you will have to institute legal action for a $6,000.00 case. As I said though, it may be worthwhile to hire an attorney for a consultation and to write a letter and see if that will be effective.
