Legal Question in Real Estate Law in North Carolina

i need to have a deed of trust released after 38 years. the original sellers have both died. how do i get an affidavit by clerk of court

The Clerk of Court is not going to sign any affidavits. You can consult with an attorney about the cancellation statutes. It might be that the statute of limitations have run by now depending on when the last payment was due.
