Legal Question in Real Estate Law in North Carolina

I live in NC. My husband has owned our home for several years. He has a notarized letter stating his ex girlfriend will get the net proceeds to the house. My husband and I live in the house. He did refinance the house, and I was added to the deed. Will the ex be entitled to all the net proceeds no matter when we sell the house?

Probably not, but without seeing the agreement it is hard to tell. For this to be a binding agreement, it must have been a contract or the ex must have given something up (for instance: the right to sue him or for child support or something like that) to get the signed letter.

North Carolina does not recognize boyfriend girlfriend rights so there is no alimony or anything similar for dating relationships. Her only way to get ANY of the proceeds of the sale of the home is for the letter to be considered a binding contract as described above.
