Legal Question in Real Estate Law in North Carolina

MY real estate agent suggested we didn't need a home inspection for a property we were purchasing because he personally vouched for the integrity of the sellers. We were shorted on several items listed in the contract, and he did nothing about it. The real estate agent also failed to disclosed the fact that one of the sellers was a convicted felon who had recently served prison time for mortgage-related fraud.

We are now (less than 30 days after purchase) having many problems related to poor workmanship done by the sellers, and other issues that were undisclosed. Our real estate guy is actually working closely with the same individuals on other properties in the area.

He was working as a dual agent, and seemed to be working more for the sellers than for us, the buyers.

Do we have a case? We would like damages to pay for repairing some of the problems found in the home.

Speak to a real estate attorney in you area and report your agent to the real estate commission. This is exactly why I don't recommend using dual agents...THEY DON"T represent you! They represent you and the seller meaning they don't really represent either of you in reality and owe you both less of a duty. This will be a difficult case due to the dual agency relationship. A skilled attorney is required.
