do we sue the property owner or contractor?

Our neighbor owns his 1 acre

property beside us. He hired

a contractor to deliver a huge

4,200 sq. foot modular. The

contractor graded the lot without knowing the boundaries and graded a good amount of our

land which destroyed many medium and large hardwood trees and has created a storm

water runoff onto our property. The contractor refuses to take responsibility.

Is the contractor liable for the damage or should we direct

our complaint to our next door

neighbor who owns the land ?

Your primary claim is probably against the contractor. The contractor may then have a claim against your neighbor if your neighbor gave him mis-information. You may need an attorney to file suit if they will not respond to you. It is less clear whether you can sue your neighbor.
