Can I sue the Seller's Agent

3 days before closing on a property (March 3rd) we found out there was a second lien on the property we wanted to purchase. The sellers agent had listed the property well below what she owed the mortgage companies and no title search was done until then?we have been in dispute about this property ever since and they are trying to get it into short sale.It has now been 4 months after the first closing date and we are out of a house, we have storage fees, we lost our low interest rate of 4.6%, we've already pd. termite, appraisal, lawyer and inspection fees before we were supposed to close. The only money that was returned to us was our earnest money. Can we sue the Sellers agent for misrepresentation? The real estate commission already concluded that they did not fully do their job when listing this property and a complaint was filed against them? We want reimbursement for everything and ethically would be in our favor, correct?
