Legal Question in Traffic Law in North Carolina

speeding in school zone in Nash County

I got a speeding ticket (50 in 25 school zone) I do not deny I was speeding but am positive I was not going 50. This is my first speeding ticket. Would I be able to use a PJC or should I get a lawyer to try to have it reduced?

25 over and in a school zone to boot is a serious criminal traffic citation - you could lose your license. There is no question you need an experienced traffic attorney. You are right at the limit for a PJC. However, a PJC is not something you are entitled to, it is solely at the discretion of the presiding judge and each judge has their own standards for granting a PJC. Would you want to be known as the judge who gave a PJC to someone speeding 25 over where little children go to school? It will be hard enough for an experienced lawyer to persuade a judge to give you a PJC on a 50/25 in a school zone. On your own, you have the proverbial snowballs chance. Also, a PJC comes with some consequences you need to be aware of. However, depending the district attorney's policies you may have options to consider.
