Legal Question in Veterans Law in North Carolina

Disability Compensation

I was involved in a one car accident in 1985 while on active duty in the Marine Corps and injured my back. I was the passenger, the driver and I had earlier drank a few beers and when paramedics arrived they notated that alcohol was evident on my breath. The driver was charged with DUI, exceeding safe speed, and failure to stop at a stop sign. I received no citations. My back has continuously plagued me and I was medically discharged from the National Guard in 2000 due to complications with my back. I would like to know am I still eligible for disability compensation although alcohol was a factor in the car accident.

Re: Disability Compensation

If you are speaking about Veteran's Disability Compensation, you can always file for it, you just may not receive it. Same is true with SSI. You should gather all medical records first. This can be tricky, on-going, and expensive.I may have an alternative for you to obtain the legal advice you may need on this issue on an ongoing basis as well as legal advice for any other future legal issues that will arise throughout your failies life. Either way, I wish you good luck.
