Who Benefits?

A woman dies intestate and leaves behind a husband and one adult son. Her benficiary for her 401K and her life insurance policies list both as 50/50. Shortly before her death, the woman was involved in an accident that is totally unrelated to her death and is the beneficiary of a large settlement.

Since she is dead, how is the courts likely to distribute this money?

The Intestate stautute provides that a surviving spouse takes 1/2 interest in real property and the first $30,000 plus 1/2 the balance of personal property. The child would get the other half.
