Legal Question in Wills and Trusts in North Carolina

Father's Estate

My dad had no life insurance. When he passed all he owned was a mobile home that had an outstanding balance of about $1400. According to his will, his debts wer supposed to be paid, a headstone for the grave and then the remainder divided among his children. The last item on the will was leave mobile to niece who took care of him. She went and paid the $1400 and took possession of the home. We got stuck with his funeral expenses and got nothing from his ''estate''. Is there anything us children can do? He passed in 1997.

Thank you

Re: Father's Estate

The expenses come out of the estate before any bequests. She should not have taken the mobile home. It should have been sold for expenses. Best Regards, Edward DiCato
