Legal Question in Wills and Trusts in North Carolina

Obligation

My sister was murdered in October. We are trying to get her business in order. Are we obligated to pay any credit cards? Some of the cards were used by the suspect,so we would be liable for anything before a certain date? Please advise. Also are we responsibe in selling her home, or does the mortgage company take over?

Re: Obligation

Her estate is liable for debt, not you personally. You cannot keep assets and not pay the debts, though.

If the mortgage company takes over the house you get nothing. If there is no equity, you may want to do that. However, even if there is no equity, it is possible to salvage some value for the estate in a "short sale." The details of this are beyond the scope of this internet forum, but could be discussed in a free, no obligation consultation. Call 480.835.1500. Report the theft to the credit card company to have illegal charges removed.

I am sorry for your loss. If we can help we wold be glad to do so. All charges could be paid from the estate. Thanks for your interest. We handle probates in all Arizona counties, if your sister was a resident of Arizona when she died.
