Legal Question in Wills and Trusts in North Carolina

Probate question

As executrix of my mother's will, I have paid her bills using money from an ''estate account''. My mom designated an annuity be used for estate expenses which I deposited into her checking account, which I have right of survivorship to. The clerk of court told me I cannot use estate money to pay utilities..why not? I had to maintain her house until it was sold and had to pay utilities.

Re: Probate question

The house is not part of the estate. It vests in the heirs at the time of death. It is only part of the estate if brought back in the estate in order to pay claims.
