Legal Question in Wills and Trusts in North Carolina

will the will hold

My brother and I were willed a piece of property, from our father, who recieved it from his father. Our cousin wants to buy it, the original will states the property must stay in the family. We are wondering if we sell to our cousin can he turn around and sell the property to someone out of the family? Do stipulations in wills hold forever, or is there a time period?

Re: will the will hold

Whether the restriction on the gift to you in the Will is a valid one, depends on the Will and state law. From your description it sounds as if there is no valid restriction, only a wish of your father. To receive a complete answer that you can rely on, go visit an experienced estate and trust lawyer in your community.
