Legal Question in Wills and Trusts in North Carolina

No will but married

My mother passed away and the home was in her name she had no Will. Does the land belong to my father (her husband)? I have no problem with that but he's old too and doesn't want to make a Will when he dies who will be in control of the home and the land??

Re: No will but married

If there is no will and the deed is only in your mother's name, then the land belong partially to your father and your mother's children. All details would be needed before being able to tell you exactly what percentage everyone has or if your father owns it outright.
