Legal Question in Workers Comp in North Carolina

Insufficient Attorney

I have a Workers Comp case. I have been out for almost 2 years with a back injury.My attorneys office is truly pathetic , I have NEVER actually met my attorney in person or on the phone.I can't even get them to make calls to my adjuster. Do I have rights to change attorneys?.. if--name removed--at what cost?.My case is in NC I reside in NJ now because of the attorneys inability to insure my payments.

Yes, you have the right to switch attorneys, but you may want to give them one last chance by calling them to discuss the status of your case. Some cases just take a long time because the person is still getting medical treatment, trying to work, waiting for a hearing, etc. There are lots of reasons why a case many not resolve in less than a year, and it may not be due to the attorney's neglect. If still no one will talk to you or return your call, you should send a letter to the current firm telling them you do not want them to represent you anymore and ask for your file (they may charge you a reasonable copying/postage fee). If/when you get a new attorney, the new firm can also get your file from the old firm. Good luck!
