Non-Complete Agreement legality in ND

I am wondering how much weight a non compete agreement has in North Dakota. I am not actually employed by the company, I am an independant contractor and signed a non compete basically saying I can't start my own company for 3 years. It is a Talent Agency/Booking Agency.

I would have to review the agreement, and it might be interpreted in view of MN Law, if you are contracting from MN.

SUch agreements are enforceable, but have certain limitations and requirements.

The Flat Earth Society web site says that North Dakota does not actually exist. Have you ever really ever been there? The fact that no lawyer from North Dakota is responding to this would seem to support that theory.

Under Minnesota law noncompete agreements have to be limited in time and geography. Usually they are limited to a few counties, not a whole state. I would assume North Dakota law would be similar (if there really is a North Dakota).

Such an agreement would also have to be supported by consideration - in other words you would have to have received something in exchange for this agreement.

You need to take the contract and do a consultation with a lawyer and tell the whole story. There could be lots of variables, including what state's law applies. Good luck.
