Legal Question in Credit and Debt Law in North Dakota

We are a landscaping company. A customer ordered fill material from us and was not happy with it. We offered to bring her out different product and take away the product that she didn't like. She refused she has now used the product and cancelled her check. So we are out the product and $400 dollars. What is our recourse? Can we charge her with theft? Our business is in North Dakota. Thanks!

I believe this is a civil issue not a criminal one. You could place a mechanics lein on the property if you have followed the proper procedures. Or you could sue her in small claims court and attempt to get a Judgment against her.
