Legal Question in Criminal Law in North Dakota

I have a record of nsf checks...and cannot go to canada to be with my fiance...h

I am getting married in 2 wks to my fiance in canada but cannot go there now because I have a misdem. charge on my record for nsf checks. What can I do to get this resolved?

You don't get it resolved. You were convicted of a crime and it remains on your record and criminal history forever.

You can apply for a pardon from the govenor, but they are seldom granted, and you will still have the prosecution record.

A pardon from a foreign jurisdiction will not necessarily wipe out the conviction for Canadian immigration purposes. However, if your record is more than five years you should apply for a certificate of rehabilitation. Unfortunately, that will take several months to process. Alternatively, you might be able to get a Minister's Permit for temporary permission to stay in Canada, but that will take time to process as well. However, you are probably not barred forever and with a sponsoring spouse may be able to get permanent resident status and then citizenship. It would be a good idea to contact a Canadian immigration lawyer where you will be living in Canada.
