I called my insurance company and said I may have hail damage. They came out assessed the damage and sent payment for repair. I would like to know if its against the law if I don't use the funds to make the repair.

I don't practice in your state and do not know what is and is not "against the law." But from an insurance perspective, the insurer has reimbursed you for the damage your property has suffered. If you don't repair it, that is up to you as long as you did not agree with the insurer (in the policy or otherwise) or with anyone else to use the proceeds only to repair.
