Legal Question in Wills and Trusts in North Dakota

Mother's estate was misrepresented

Our brother named himself PR of our Moms estate, the rest of us four siblings trusted him...We have been ripped off! He kept property, sold property & kept the money. He got the business & inventory. His attorney had it written that we would receive no accounting of the estate. Can we protest?

Re: Mother's estate was misrepresented

You always have the right to challenge a distribution of a parent's estate if you have an interest in the proceeds of it.

Frequently, a decedent will include in their testamentary documents "no contest" clauses that will prevent you from challenging the distribution of assets.

It would depend on the language of the will/trust to determine what your rights are.
