What happens to my childern if i die?

I have 3 children there father is not around. He doesn't pay child support as ordered. Never comes to see them or call to check on them. I'm married now TO a wonderful man who takes good care of my children my youngest son knows no other father. Is there a way to make there stepfather the one who they live with if something were to happen to me. I don't want my husband to have to fight for the children he raised is I die. is there a way to plan for that legally?

One option would be to have the stepfather formally adopt the children. If biological father consents to this, he would give up his rights to the children and those rights would then be assumed by stepfather. If biological father contests this, there may be issues getting the adoption to occur, but it does not automatically prevent the adoption from occuring.
