Legal Question in Business Law in Ohio

I have a business partner concerning a show horse. It was a handshake deal with promises made to sell if it didn't pan out. 5yrs.later the horse has produced nothing-no show points, no breedings. Partner has also borrowed 3k which he has defaulted on. The partner has become evasive and passive agressive. He doesn't want to buy me out or sell it at an auction. Is there a way to get a court order to sell? Do I have any standing at all or am I at his mercy?

Dear Investor: You may have to file a lawsuit for partition, i.e a division of the partnership with a request to the Court for a determination of your rights to be repaid, etc. As the Plaintiff, you have the burden of proof, i.e. you must be able to produce evidence (proof) of your loan, by a cancelled check or writing, and proof of your intended investment, with testimony by any witness as to the original handshake agreement, and to the lack of training, breeding, etc. as promised.
