To the other attorney answer, any franchise attorney will say copyright does NOT protect a name. A search of the records at the USPTO website will show who has registered a particular name federally. But a more comprehensive search by state, etc. is also a good idea because not everyone does a federal registration. Consult with a good franchise attorney or business attorney in your area for specific advice.
