Acquiring Ownership of domain name

I am the IT manager for ABC motors. Registrant and owner of the domain name abcmotors,com is XYZ Marketing here in our small home town. Domain was registered in 1996. Cannot locate XYZ Marketing nor the owner and have been trying for several years but no luck. He was old in 1996 and could be dead by now. Registrar of domain is Markmonitor and domain admin is yet another company. What are steps to acquire ownership from XYZ marketing to ABC motors? Thanks

It sounds like someone is using false whois information to try to keep this domain. First thing you want to do is file a false whois information complaint. If that doesn't get results, then you have an administrative and a federal civil court option, which cost more. Contact me and we can talk about how long this would take and cost and other possible intellectual property vulnerabilities of your company. Getting that domain name will definitely get you that traffic.

A little unclear as to the facts that you are presenting. Does your company have content on this Web site, or is it a cyber-squatter?

My impression is that your company used an outsource domain hosting company that did your site, and now you are trying to have the Registrar change the WHOIS data to reflect your company as the new Registrant (in place of the defunct marketing company). If so, the answer depends very much upon who the Registrar is and what its policies may be; some (like GoDaddy.com) are impossible, but others (like Register.com or AITDomains.com) are quite helpful in fixing this kind of problem.

At worst, you would have to obtain a court order against the defunct company directing the transfer of the domain name (not too hard or expensive if there is no opposition to the action), and then provide that order to the Registrar.
