Legal Question in Consumer Law in Ohio

fraud?-paid for car, never got car or money back
a few months ago, my fiance met a car dealer that
bought cars from a car auction. he told my fiance
and i that he could get us just about any car we
wanted for a cheap price because his best friend
worked at the car auction place. we chose to buy
a 1999 chevy blazer, so we wrote him a check for
the price of the car. it has been a few months
since then and we have not received the car or the
money back. this car dealer has just given us
excuse upon excuse as to why he cannot give us the
car or the money back. please tell me if we can
sue him to get our money back, because our bills
are now overdue and we are losing our home because
since we don't have that money we can't afford to
live there anymore.
