Legal Question in Consumer Law in Ohio

Recently I used Premier Parking valet services while going to dinner at a local restaurant. I spoke with the man parking my car about potentially leaving it over night and he said that it would not be a problem at all. He never mentioned anything along the lines of needing to move the car or getting my keys from him if I left it overnight. I ended up getting a ride home that evening. When I went to get my car I could not find it in the lot the company had said it would be located. I called the owner to meet me, he said he would meet me in front of their parking booth and failed to show up. I ended up talking to someone from another valet parking company in that area, who told me that company moves the vehicles onto the road at the end of the evening which is a tow away zone and my car could possibly have been towed. With no help from Premier Parking with locating my car, I ended up finding it at the city's impound lot. I had to pay $211.00 to get my car released. I called the owner after I got my car and told him the story and how upset I was with the lack of communication from his company and would like my money for the tow refunded. He said he needed to talk to the employees that were on duty that night and would get back to me with a resolution. I emailed him my complaint and did not hear from him after a week. I then called him to check up on the resolution and he quickly blew me off and said he would call me when he spoke with his employee. I still had not heard from him after another week later so I contacted him again. This time he told me the employee was on vacation (two week vaca... nice) and did not have a chance to get a hold of him, I was told once again I would be contacted by the end of the week and still have not been. I am angry and feel very mistreated, and mislead.

This is the complaint I submitted to the BBB. I still have not heard back from the owner of the company. My question is what would my next step be in pursuing getting my money back? Small claims court?

Assuming this occurred in Franklin County, file an action in Franklin County Small Claims Court for an amount up to $3,000. This will get their attention.
