Ex son in- law purchased motorcycle in North Carolina, (83 year old) grandmother in- law

He has been in default on the payment and this has been turned over to a firm in Calif. I am in Texas trying to protect my mother. He is planning on filing bankruptcy. What states laws do we go by, and what can my mother do to protect herself

Re: default on a motorcycle payment

Your mother can do nothing to protect herself. She signed as a guarantor on the loan. That means she pays if he doesn't. Bankruptcy protects him, not her. I suppose she could do bankruptcy if she wanted to. Hopefully, she would not die within the 5 years for a Ch. 13 discharge. Sorry for your grandmother. Maybe the ex son-in-law had good intentions at one time.
