Legal Question in Credit and Debt Law in Ohio

My husband cosigned on an apartment for his brother and his girlfriend. They went delinquent and we are now obligated to pay the debt. My brother-in-law has not paid this bill just to spite us, so we would like to make him legally obligated to pay us back. Is there any legal action we can take against them?
