Legal Question in Credit and Debt Law in Ohio

payment accepted

We received a summons for a judgment on a credit card. We had been late on all of our bills, by about 3 months, due to an injury of the only income provider. All of the companies worked with us but one. As soon as we got caught up, we immediately sent payments. One company received and cashed a check payment 1 day after sending us a collection letter. Now 3 weeks later they want us to go to court. We do not argue owing them but we do argue that there should be a judgment. Can they accept a payment and sue us at the same time?

Absolutely. Generally, acceptance of payments is not a waiver of any rights.
