Legal Question in Criminal Law in Ohio

what happens now

3 days ago i get a call from a detective to come see him. i spoke w him and he showed me a report that they found my fingerprints in a house that had been burglarized. i told him i didnt remember being there because sometimes i blackout if i drink. after talking with him i started asking friends what happened that night. i received a call from a girl (i dont know her name)and she told me that we were intoxicated and entered an unlocked and unoccupied house. there was still property in the house. the owners recently moved out. the girl and i engaged in sexual activity and left. he wont quit calling me to come back and fill out a statement. what should my next course of action be? what can i be charged with?

Re: what happens now

This is probably a simple crime of tresspass, but the officer could be looking at is like a burglary. What your question does not say is whether anything was taken from the house. Maybe you took something and don't remember, maybe the girl took something, or maybe someone else took something but did not leave their fingerprints.

Another issue is whether the girl was old enough to consent to sex. Your question implies that she was, but that is an issue an attorney should review before you make a statement to the police.

I would not want you to talk with the police again without an attorney to look out for your interests. If you hired me, I would have an investigator take a sworn statement from the girl to lock her into the facts.

Your next course of action should be to hire an attorney. Burglary is too serious of an offense to take a chance.
