Legal Question in Criminal Law in Ohio

Attempted burglery?

If a person tries unsuccessfully to enter a residence by breaking the glass on the door, and cuts his artery on his arm, and bleeds unconscience, but does not enter the home, is this attempted burglery? He wasn't trying to burglerize. He wanted to talk to his xgirlfriend who would not talk to him, and he was drunk, and high on cocaine thanks to his fraternity misfits. We do not want to press charges. He needs to be admitted into a psychiatric unit after his arm heals from surgery. The police are going to pick him up when he is well enough to be released. What do we do?

Re: Attempted burglery?

If i'm reading the question correctly, you are the property owners where this gentleman broke the glass and was found, correct? If so, then you need to discuss with the prosecutor what your desires are regarding the charges and final disposition. If the property owners are not willing to press the charges, then you'll find that the prosecutor will likely not be interested in pursuing them either. Mediation or diversion might be in order to get this boy the help he needs. Good luck.
