Legal Question in Criminal Law in Ohio

My family goes to a local wing establishment often. We know the employees well. This is a national wing chain. Last night one of the employees jokingly grabbed my 13 year old son when he was leaving the bathroom and took him back in and put a trash bag over his head, another employee poked a hole in it and my son told them to stop. The original employee then picked him upside down (still with the trash bag over his head) and put him in the trash can. Then pulled him out when my son was panicking. He then became ill. My question is, should I contact the police? Should I contact a lawyer? I sent an email to the store last night but have not received a reply or phone call.

You will probably want to contact an attorney about the best way to proceed. The trouble that you are going to run into is that there aren't any actual damages unless the child had to be taken to a psychologist or psychiatrist to deal with the stress from the incident. Horseplay like this often will not get much of a jury award absent a physical or demonstrable mental injury.
