felony 4 carrying a concealed weapon

my boyfriend was along side the rode ran out of gas well during the day he had taking some oxicotins so he was a lil on the messed up side. he had this in the car with as long as a bowl for smoking marijuana. in his back pocket was a gun . well they areested him. they did not find the gun untill they had him at the jail house they are charging him with a felony 4 carrying a concealed weapon. I am not sure if they had reason to search car it was in my name adn he was drving w/o a lic. is that reason enough. they officer said he found the gun in the car but didnt . is this reason to drop these charges. I nned to know if this is something we can fight or just waisting time and money and should he go ahead and plead gulity to thsi gun charge.. thanks

Re: felony 4 carrying a concealed weapon

It is never wise to plead guilty to a felony without an attorney. The information you provided raises some serious issues but it is hard to say whether your friend will be able fight this successfully. One thing is certain. A felony on your record is not a good thing. Neither is going to prison! Tell him to get an attorney. Pay for one if he can. Borrow the money from family or friend if he doesn't have it. If he just can not get the money then ask for a public defender!

Good Luck
