Legal Question in Criminal Law in Ohio

Juvenile Criminal Issue

My 12 yr. old daughter has been suspended from school for writing a note that was found after school. The note was written at home, about a month before being found at the school. The note was not taken to school on purpose, and my daughter stated that she had no intention of ever taking the note to school, but it had gotten mixed up with her school work while she was at home. My daughter was taken out of lunch period, held and questioned for over an hour by the principal and asst. principal before anyone bothered to contact us about the issue. To be honest, the note was a death list. My daughter wrote this at home because she was upset about being picked on at school. My daughter made no direct threats to anyone and had no intention of making this note public. The matter has been turned over to the police and we are waiting for a school board hearing to see if she is expelled from school as well as whether or not criminal charges will be pressed against her. My daughter has stated more than once that she wished no harm to anyone on her list, only that she was upset about being picked on at school. My questions are, what are the chances she will be prosecuted, and should we hire a lawyer?

Re: Juvenile Criminal Issue

Its impossible to say what the chances are of criminal charges being filed against your daughter. But if I were you I would take a proactive approach to this matter and hire an attorney, not only in dealing with law enforcement but also with school officials. My office is in Canton. If you wish to discuss it further, feel free to email me directly.
