Legal Question in Criminal Law in Ohio

probation violation

My fiance' got arrested in October 07 for felony five cocaine charge. He was put on probation and they revoked his driving priviledges for 6 months. Yesterday, like a fool, he took his Harley around the cul-de-sac in our neighborhood and was pulled over. They gave him a misdeamor 1 charge and he has to show up in a township court on 4/11. He just got sentenced March 4 on his original charge and is scheduled to see his probation officer tomorrow, April 2nd. Our daughter was just diagnosed with Level 5 cancer. The doctor and myself asked for driving priviledges for him (letters dated March 27) before all this happened. Is he looking at time? My main concern is our daughter becuz I can't continue to drive him to and from work and his drug testing (which he has passed all of them) and community service and take care of my daughter's failing health. Will the court look at ALL the circumstances or just the violation?

He is in trouble. He is legally required to report this to his probation officer, and if he doesnt he could be in worse trouble. The D.U.S. shouldnt be a problem, it is the judge who just sentenced him that is problematic. Feel free to call me directly. 216.952.1990
