Re: Statuatory?

One would need more information to give a final answer, but at a minimum this would be sexual battery, which is third degree felony. Felonies of the third degree carry a possible punishment of 5 years in prison.

I cannot imagine any reason why an 18 year old would risk prison to have sexual relations with a child of 14 or 15 years old. There is no acceptable reason in the eyes of the law. Even if the child was willing (even initiated the sex) it is still a crime.

I hope this helps answer your question. There are circumstances where the crime could be worse, and a few circumstances where it might be a lesser offense, but in general sexual battery describes the conduct you asked about.

A word of caution. If the police contact the 18 year old, he or she should not talk to the police without a lawyer under any circumstances. The lawyer should be physically in the room with the person before they speak to the police. No explanation will satisfy the police and if the 18 year old admits to any sexual activity with the child they will be charged with a crime.
