Statutory Rape

My daughter is 20 and had sex with a male just prior to his 16th bithday, in his mother's home and she had knowledge of it. She is now pregnant, can she while seeking paternity and child support be charged with statutory rape? The mother of the male is trying every angle to keep her son from acknowledging paternity.

There are a variety of charges which could result from this situation ranging from sexual imposition to sexual battery. I don't think that a prosecutor would pursue rape charges given the facts presented, however, there is no guarantee.

In some counties the parents of minors are being charged for allowing their children to have sex with adults. I recently handled such a case in Morgan County.
