Legal Question in DUI Law in Ohio

appeal?

My brother recently recieved a dui and had court today. He is 22(21 at the time of the offense) and has had a couple small run ins with the law and alcohol(under age). In court today, the judge, prosecutor, my brother, and his lawyer all agreed that a dui program and $500 fine would be his punishment. He came out of the courtroom, to get ready to leave, when a PO, not his own, told him that she did not like the ruling and sent him back in to get another one. The judge, a retired visiting judge, changed his ruling to $500 fine and added ten days in jail. What is my brother to do? He is a college student with no money for the lawyer( my husband and I paid for the lawyer fees this time and we can't afford to do it for him again). Could it be a mistrial? Should he appeal or fight this in any way? Is there a way to get out of the jail time? I appreciate your help in any way. Thank You for your time. MK
