Legal Question in DUI Law in Ohio

Need help

I was in Columbus OH over the july 4th weekend. We were staying in a hotel. I take ambien sleep med. I had a episode of sleep walking and driving my car, ONLY in the Private parking lot and side swiped a car. I derectly parked my car back where i came from. and the cops showed up around about 45 min. last. At which that point I had went back into my room and had a few achololic beverages. when the cops arrived I was in my room and he told me to come out side and proceeded to preform a field sobriety test on me. Then he held me inside his car and tested me about 2 nd a hold half hours later. which I blew a .112 on the breath test. At that point my car was towed off privated property and inpounded and my PA drivers license was held. I have been on the sleep meds for over two years due to major back surquey. All the info on the commercial and on the drug sheets that the pharmacy gives with the prescription list sleepwalking and walking and driving without remembering it. what should i do?

If this really is what happened, then you are going to have to take this to a jury trial... I dont believe with these facts that a prosecutor is going to give you a reduction....Notably, giving you the test over two hours after you were stopped may be something that gets the case thrown out earlier, but regardless, you have a fight on your hands!! Your credibility will be scrutinized....witnesses will be important as well...

This is a case where you must hire an attorney to assist you with the defense. Under Ohio law, the charge of operating a motor vehicle while impaired (OVI) is a first degree misdemeanor. It carries the potential of six months in jail and a fine of up to $1,000.00, plus the loss of driving privileges. Pennsylvania will honor the Ohio suspension of your license.

There are many issues that need to be looked at, not the least of which is that there is a 2 hour time limit to give you the breath test. You need an attorney in the Columbus area (I am in the Cleveland area). You may want to try the Franklin County Bar Assoc. for a referral or look in the yellow pages for lawyers who handle OVI/DUI in the Columbus area. Good luck!
