Legal Question in DUI Law in Ohio

dui sentencing

My boyfriend got a dui should have been 2nd offense. The judge made it a 5th in 20 years. Can a judge do this and what should we do if she can't. She sentenced him to 60 days with 20 mandatory. I have called attorneys in my home town and i can't get a answer without going in for a consultation. Please help.

Although generally the DUI "look-back period" is six-years, if your boyfriend has had prior DUIs throughout his lifetime, the penalties can get more serious.

The lookback period for DUI's changed in september from 6 yrs to 20 yrs.

If he accumulates 5 in 20 yrs, it can enhance it to a felony and a term of one year in jail can be imposed. He should have hired an attorney from the beginning and this might have been avoided.
