Legal Question in DUI Law in Ohio

My son 18 years of age was caught 1.operating a vehicle under the influence of alcohol. 2.blood level .065 on BAC test. 3. No drivers license 4. not having headlights on in the night.

So 4 counts in all. He is a senior in H.S. and has never been in trouble as a juvenile or since turning 18.

What type of sentence might he receive?

I would strongly suggest you contact a knowledagble criminal defense attorney. If convicted, it will remain on his record and have significant lifelong impact. When it comes to DUI, there is the potential for alot of ways for a good defense attorney to work out a favorable result. There are times when the sample used to calibrate the breathalyzer is bad, rendering the results inadmissable in court. (This just occurred in our local area again, and for those attorney's that check such things, it meant that over 2 weeks of DUIs from that jurisdiction are being dismissed). Even if the prosecution has a great case, there is the opportunity for a good attorney to negotiate a favorable plea arrangement, potentially to an offense other than DUI, as well as to mitigate the sentence.
