Legal Question in Education Law in Ohio

How would you decide this case?

A plaintiff signs an agreement with a school, agreeing to pay tuition for her son to attend the school. The plaintiffs ex husband has joint custody of her son and refuses to send the child to the school. The plaintiff asks the school for her money back from the school and she recieved a verbal promise from the headmaster that her money would be returned. The school later refused to to return her money. She did not expect the school to provide any educational services to her son.
