Legal Question in Education Law in Ohio

Rehiring retired employees

Within an Ohio school system what are the legalities involve in rehiring employees (both teachers and administrators) that have retired? What time frame is the school system obligated to keep them? Are they eligible to receive unemployment benefits if the system does not renew them for additional years?

This link should have all the information you need concerning reemployment of a(n) STRS retiree.

As for unemployment compensation, that is a fairly complex subject. Although it seems like reemployment would confer coverage; unemployment compensation is reduced for retirement income which is based upon employment during your base period (generally a 12 month period beginning 18 months before you apply for unemployment). I have to confess that I don't know if reemployment (after your initial retirement) by the same entity (school district) would cause that set aside to be implemented. Hopefully, someone that does more unemployment comp work would be able to answer that question for you.

If you need additional information, please see the STRS and Ohio Department of Jobs and Family Services web sites. If you need assistance beyond that, you might want to speak to your HR office, your union representative or to a local attorney with a good reputation and some experience with state retirement systems and U Comp.

Good luck with all of this and have a long and happy retirement!
