Legal Question in Elder Law in Ohio

My Mother was in the hospital for an operation recently. My Mothers health is getting worse all the time because of her diabetes, and other health issues(83 years old)-My Father has abused her for 60 years,i told the hospital that my Father cannot help her at home because he is an awful person to her. He is very controlling,i wanted my Mother to stay at her Sisters house that lives not far away, again because my Father is a terrible person with my Mother, the hospital said there hands were tied, unless my Mother said something???? My Mother just got out today(August 8,2018,back home with my Father. Can the hospital be held liable for turning a blind eye on this>? Also, she was in there because a Doctor gave her the wrong medicine in the first place, she went into a diabetic coma at home because they didnt check the other medicines she was on.

If your mother is of sound mind, you may ask her to execute a healthcare power of attorney to you can make the medical decisions for her and also a financial power of attorney. Another more drastic measure is to obtain guardianship of her so you would be able to make all decisions for her regarding her person and estate. If you mother is of sound mind, she should report your father's abuse to the proper authorities or you can if you are afraid for her safety. Here is some useful info:

Reporting Abuse to the Domestic Violence Hotline:

The Domestic Violence Hotline is a national resource used to prevent acts of domestic violence. Furthermore, the Domestic Violence Hotline is one of the many places an individual can contact to report abuse; the hotline acts as the intermediary between the aggrieved party and coordinating law enforcement officers.

The Domestic Violence hotline can be accessed via the Internet at https://www.thehotline.org/ or via telephone at 1-800-799-SAFE(7233). The Domestic Violence Hotline offers an anonymous report feature, which enables a victim or a friend of victim to report an incident without giving their legal name.

You may have a medical malpractice claim against the doctor as well for giving her the wrong medication and causing her go into a coma. If you need assistance, I would be happy to help. www.socrateslegal.com
