Legal Question in Family Law in Ohio

I have 50/50 shared parenting with my 18 year old daughter and 17 year old son. In our divorce agreement 14 years ago we agreed that my x wife would use my daughter as a dependant on her taxes and I would use my son on mine. With my x having a drinking problem mixed with anger issues, she hit my daughter along with constantly putting her down, so at the age of 15 my daughter started living with me, but we didn't do it with making changes in custody with the courts. My question is, can I use my daughter as a dependant on my taxes since she has lived with me full time for the past 3 years? She turned 18 10-31-2011.

You would be best advised to file a motion with the court to get the divorce decree amended so that you can claim your daughter as a dependent, arguing that the new custody arrangement makes that fair and reasonable.
