my husband was discharged from the ARMY on a section 8, lives with his mother and has threatened to harm even kill himself if i divorce him i have the divorce papers in the works but what are the chances of him getting my babies (both girls and his) that have been with me all there lives and he has only seen slim to little and is very unreliable with helping financially with them

From what you write, you're problem at the moment is not custody of your children, but your and your children's safety. Even a threat of violence is a form of abuse. Please discuss your situation with a women's shelter or protective services or an experienced attorney. On the one hand, these may be idle threats, but, on the other hand, he may be very unstable and unpredictable.
