Legal Question in Family Law in Ohio

contempt while appeal is pending

my ex-husband has filed an appeal on our divorce judgement.I have filed a motion for contempt against my ex because he did not return property and pay money owed to me as ordered by the court in the divorce judgement. My ex-husband has not filed a stay. Can the court of domestic relations proceed with the contempt case even with an appeal pending? Also, is there a time limit on filing a stay?

Re: contempt while appeal is pending

Generally speaking, the trial court will withhold action if the issues appealed involve the contempt issues. As to the stay, that depends on the local rules of court in the county.
