Legal Question in Family Law in Ohio

I just had a dissiloution finalized April 7,2010. the court papers say We have 45 days to submit to our 403B plan to divide the money between the ex and I. We paid the lawyer a week ago to get the papers started for us to sign so he could submit. but he still hasnt done it yet. There are only 15 days before the 45 day limit is up. Will that affect me from getting the half of the 403B. if its is the lawyers fault for not filing it on time.?????
