Legal Question in Family Law in Ohio

Ex-Spouses Rights to Inheritance of New Spouse & Husband

I inherited money upon my father's death. My husband and I plan to reinvest this money in both of our names. Should my husband's first wife want to take my husband back to court for more money, would she be able to get some of the money I inherited from my father if my husband's name is on the new investment. I, of course, obtained this money long after the divorce from his first wife and our marriage took place. Am I protected from her?

Re: Ex-Spouses Rights to Inheritance of New Spouse & Husband

You should be fairly safe. Inherited property is a nonmarital asset. Therefore, she should not be able to attach it for spousal support. The income from the investments may be used to increase child support. However, you should retain the records of the transfer so that you can trace the origin of the asset.
