Legal Question in Family Law in Ohio

How do I file for custody of my 7 year old son who is in temporary foster care in Idaho and I live in Ohio? Children services in Idaho told me I needed to file in order to get him home with me. He was taken from his mother due to her drug habits, and unsafe environment for our son.

Much depends upon whether or not you have established yourself with the courts as the boy's father. If you have not done that, then you will need to open up a juvenile court case to establish your father son relationship with the child. Once that case is opened up, then you can ask the court for an order giving you custody of the child and the Idaho courts and foster care agency will likely honor that order when a certified copy of it is presented to them.

If there is already a court finding that you are the boy's father, then you need to file a motion for custody with the court and then there will be a hearing upon the matter. If the Judge decides in your favor then you can take a copy of that to Idaho and their courts and agencies would likely honor it without much trouble.
